MEDIA RELEASE – CANADA’S HIGHEST COURT FORCES MEDICAL DOCTOR TO RELEASE PRIVATE HEALTH RECORDS

TORONTO — Dr. Rochagné Kilian, a respected emergency physician and health advocate, has encountered a significant legal setback in her ongoing battle with the College of Physicians and Surgeons of Ontario (CPSO). Following the Supreme Court's denial of her leave to appeal on October 11, 2024, Dr. Kilian is now required to surrender over 519 patient records, raising serious concerns about patient privacy and confidentiality.
Dr. Kilian achieved worldwide attention in 2021 following the CPSO's scrutiny of her provision of medical exemptions for the COVID-19 vaccine to several patients, citing the lack of long-term safety data as a critical concern. Dr. Kilian’s actions placed her in direct conflict with CPSO guidelines, which assert that there are "almost NO valid reasons" for receiving a COVID-19 vaccine exemption. This ethical dilemma highlights the tension between a physician's duty to protect their patients and the regulatory body's stringent stance on vaccination.
"My patients have entrusted me with their most personal and sensitive information," Dr. Kilian stated. "This ruling undermines that trust and sets a troubling precedent for patient confidentiality in Canadian healthcare. Additionally, I stand by my responsibility to advocate for my patients' health choices, especially concerning a vaccine that lacked long-term safety data at the time. Patient Advocacy is one of the requirements by the Royal College of Physicians and Surgeons of Canada articulating a comprehensive definition of the competencies needed for medical education and practice.”
The recent court ruling mandates that Dr. Kilian provide access to her patients’ confidential medical records as part of the regulatory investigation, even though no complaint was raised by either a patient or a health practitioner within the patient’s circle of care. This decision has prompted widespread alarm among her patients and health advocates who believe that such actions violate fundamental patient rights to privacy and confidentiality.
Supporters from across the world have rallied to Dr. Kilian’s side, emphasising the importance of preserving patient confidentiality in all healthcare settings. Her cause has become part of the growing canary in the cave chorus Canada has experienced in recent years, opposing state overreach and encroachment. Many believe that the CPSO's actions could have a chilling effect on practitioners who are increasingly grappling with the public perception of being extensions of Big Pharma’s agenda, dissuading health practitioners from prioritising patient privacy in fear of suspension.
As per her patient instructions, Dr. Kilian acted in her capacity as Health Advocate to defend against the CPSO’s application to compel her to release confidential patient health information. A decision that has seen Dr. Kilian’s license temporarily suspended for more than three years, creating another administrative legal conundrum for the CPSO. The CPSO will eventually have to prove that it was reasonable to protect the public from harm by temporarily suspending Dr. Kilian for an unprecedented three years.
Furthermore: It has almost been a year since Dr. Kilian was once again thrust in the limelight when she volunteered her service to both Israel and Palestine following the conflict that erupted on October 7, 2023. Dr. Kilian requested a temporary rescission of her temporary suspension “to answer the call to provide medical assistance in Israel to any individual who requires it, irrespective of their ideological affiliation and nationality”. The CPSO responded that the suspension will not be rescinded and will remain in place while the investigation into Dr. Kilian continues.
As Dr. Kilian navigates this challenging situation, she remains committed to fighting for her patients and the principles of medical ethics and standard of care. She calls upon her community and fellow healthcare professionals to join her in advocating for stronger protections for patient privacy rights.

I am right now in a zoom where Dr. Killian and her lawyer presented the verdict and the implications, etc. of her VALID advocacy in Ontario's medical tyranny.
It is upsetting and wrong but it may ust wake more people up to understand the communism which is on a speedtrain headed straight for us.
